Punishment for violating the sodomy statute ranged from two (2) to five (5) years in prison

In 1795, Illinois, as part of the original Northwest Territory, adopted the English buggery law through an ordinance issued by the territorial government. This made sodomy committed by males a capital offense.

In 1795, the Northwest Territory, which Michigan was a part of at the time, adopted the common law of England. The common law of England punished sodomy with the death penalty. However, it is unclear whether or not this law was in force in Michigan.

In 1795, a Council in charge of creating laws for Ohio adopted a statute that included the common law of England and English laws adopted prior to England's settlement of North America in 1607. England's buggery statute which mandated the death penalty for male on male buggery was therefore adopted.
