Article 80 (L. 28 March 2023)

(1)Any person who commits an act classified as a felony or misdemeanour on account of one or more of the factors referred to in article 454 may be sentenced to twice the maximum penalty of deprivation of liberty and the fine imposed by law against that crime or misdemeanour, within the limits of articles 8, 9 and 15, 16 and 36.
The provision of the first paragraph shall not apply to an act classified as a felony or misdemeanour committed on account of one or more of the elements referred to in article 454, in respect of which that element or elements is the constituent element of the offence.
(2)Any person who commits an act classified as an offence by reason of one or more of the elements referred to in article 454 may be sentenced to twice the maximum fine imposed by law against that offence, within the limits of article 26.
Article 454 (L. of 20 July 2018) provides for the following grounds origin, skin colour, sex, sexual orientation, sex change, gender identity, family status, age, state of health, disability, morals, political or philosophical opinions, trade union activities, membership or non-membership, real or supposed, of a particular ethnic group, nation, race or religion.

Article 454 to 457 of the Luxembourgian Penal code prohibits discrimination on the basis of sexual orientation and gender.

Employment discrimination is illegal

Article 1 of the Law on Equality (2006) prohibits discrimination based on sexual orientation. Article 2 states that the protection applies to the public and private sectors with regard to housing. It does not include gender identity among its protected grounds.

After same-sex marriage was legalized, same-sex adoption was also legalized on the same terms as adoption for heterosexual couples.

No protections exist for intersex infants from genital 'normalisation' surgery.

In June 2021, the possibility of drafting legislation to ban medically unnecessary surgery on intersex children began to be discussed by an "inter-ministerial working group". However, in August 2023, it was declared by the Minister of Health that the task of drafting such legislation would have to fall to the next government, given that the working group had not yet agreed on the scope of the ban.

Luxembourg reportedly enlists soldiers of any sexual orientation, but less is known about transgender soldiers; however, they are believed to be prohibited.

Since January of 2021, the Red Cross in Luxembourg has been accepting all donors without discrimination regarding their sexual orientation. They no longer ask donors about their lifelong sexual practices, they only ask donors about their sexual practices during the last twelve months before donation.

Conversion therapy is legal in Luxembourg but is not often practiced.

Age of consent is equal and is set at 16.
