Article 325-2 of Mali's new penal code criminalises homosexual sex in private, and any such act is considered indecent assault. It was passed by the military junta and came into effect in December of 2024.

In 2011, Mali's Family Code came into effect. Article 280 defines marriage as between a man and a woman.

In 2023, Mali's citizens approved amendments to their constitution via a referendum. One of the amendments defines marriage as a union exclusively between a man and woman.

Article 4 of the Law on Associations (2004) forbids the registration of associations with objectives deemed "contrary to law and morality." In November 2021, authorities detained multiple women following a complaint from a mother alleging her daughter's involvement in an "online network" of lesbians.

Researchers have found that searches for LGBT related subjects on the Malian internet are curated to provide anti-LGBT results. The country has an authoritarian government and appears to control the flow of information online.

There is no legal framework for transgender people who would like to change their gender.

Gender-Affirming Care may be restricted.

Similar to there being no legal framework for transgender people who would like to change their gender, there is also no framework for non-binary or intersex individuals who would like to legally identify as such.

There are some limited protections based on sexual orientation.

-Decree of 09/10/2020 on Gender assessments in Energy Projects protects sexual orientation under "Vulnerable groups" definition.

-Civil Servant Welcome and Integration Handbook issued in 2013 by the Office of the Commission for Institutional Development, states that all employees with the same status have the same rights with regard to the service and no distinction may be made based on the basis of sexual orientation."

-Manual for Providers for Care of victims of sexual and gender-based violence, issued in 2014 by the Ministry of Health, states that victims have the right to access services without discrimination based on sexual orientation. Also, one of the guiding Principles is to "Ensure non-discrimination" regardless of gender or sexual orientation.

-The Reproductive Health Procedures, issued in 2019 by the Ministry of Health, states that no one shall be discriminated against in their sexual and reproductive lives, or in access to health care and/or services, on the grounds of sex or sexual orientation.

-The Prisoner's Guide issued in 2021 by the Ministry of Justice and Human Rights states that a person must not be subject to any discrimination in detention or differential treatment based on prejudice, including, but not limited to sexual orientation.

Some laws protect "sexual life" as senstitive personal data:
-Law No. 2013-015 on the Protection of Personal Data in the Republic of Mali.
-Law No. 2015-015 Regulating Credit Information Bureaus.

There are no laws in Mali that prohibit discrimination in the workforce towards the LGBTQ. As such, discrimination towards LGBTQ people during work hours happens quite frequently.

There are no laws in Mali that prohibit discrimination in housing towards the LGBTQ. Because of this, LGBTQ people often face discrimination when trying to buy or rent property and housing.

Included in Article 522 of Mali’s people and family code is a ban on adoption by gay people. This part of the article when translated to English reads: “ Under no circumstances is a homosexual allowed to adopt a child under any regime whatsoever.”

There is no ban on surgeries performed on intersex infants in Mali.

There are no specific regulations on LGBT people's military service, but it is presumed to be illegal due to the military Junta's criminalisation of homosexuality.

The National Blood Transfusion Center states that the donor must complete a questionnaire that allows the doctor to ensure that he or she is in good health, which could make donation difficult for LGBT people.

There are no official sources from the Ministry of Health regarding the questionnaire for donating blood.

In Mali, there is no ban on conversion therapy, and they are very common in the heavily Muslim nation. According to research done by GPAHE, when users searched for conversion therapy on Google in West African Countries, the results were controlled by authorities. As such, the results often showed religious texts saying that homosexuality is wrong and anti- LGBT websites.

Homosexuality is illegal.
