Homosexual activity was decriminalised in Hungary in 1961.

Civil unions are recognized since 2009, a couple in a civil union has the same rights as a married couple, however the partners can’t take each other’s surname and they can’t adopt children. Since 2012, the Constitution of Hungary has defined marriage as a union exclusively between a man and woman; effectively prohibiting same sex marriages.

In April of 2025, the Hungarian government passed a constitutional amendment giving the government the power to ban LGBT events and discussion of LGBT topics. The punishments may incur a fine for up 200,000 Forints (€500) or the loss of citizenship for participants and even 1 year imprisonment for organizers. Additionally, the government is reportedly now using facial recognition technology to enforce its censorship laws.

On International Transgender Day of Visibility 2020 Hungary's parliament submitted a bill to amend the definition of sex to match sex at birth, making it impossible for individuals to change their legal gender.

On January 31st 2023, the Constitutional Court of Hungary issued a ruling that will continue to block new applications from transgender people for legal gender recognition.

Despite no concrete laws targeting gender affirming care, due to other anti-LGBT laws, the limited availability of gender affirming care for minors, a complete ban on surgeries for minors and generally conservative attitudes it is restricted for minors.

Hungary's constitution explicitly recognises only two genders.

Section 216 - Violence against a member of a community
(1) A person who, because of the fact that another person, actually or presumably, belongs to a national, ethnic, racial or religious group or another group of society, in particular because of his disability, gender identity or sexual orientation, displays a conspicuously anti-social conduct that is capable of causing alarm in members of the respective group is guilty of a felony and shall be punished by imprisonment for up to three years.
(2) A person who assaults or coerces another person by violence or threat to do, not to do or to tolerate something because he, actually or presumably, belongs to a national, ethnic, racial or religious group or another group of society, in particular because of his disability, gender identity or sexual orientation, shall be punished by imprisonment for one to five years.
(3) The punishment shall be imprisonment for two to eight years if the criminal offence of violence against a member of a community is committed
a) with a weapon,
b) with an instrument capable of causing death,
c) by causing significant harm to interests,
d) by tormenting the aggrieved party,
e) by a group, or
f) in a criminal conspiracy.
(4) A person who commits preparation for violence against a member of a community is guilty of a misdemeanour and shall be punished by imprisonment for up to two years.

The Equal Treatment and the Promotion of Equal Opportunities Act (CXXV 2003) protects sexual orientation from discirmination.

Law V-2025 amended Law CXXV 2003 and repealed Section 8(n) which protected "sexual identity" from discrimination.

Although same-sex couples cannot adopt jointly, adoption by individuals is illegal regardless of sexual orientation or partnership status. Stepchild adoption is only available for married (different-sex) couples.
