Homosexuality has not been criminalised in Côte d'Ivoire because when they were governed by the French penal code as a French colony, sodomy was not criminalised, and to this day it has not been criminalised by successive governments. However, the penal code imposes a higher punishment on homosexual sexual activity in public than heterosexual.

The 2019 Law on Marriage defines a marriage as a union between a man and a woman, effectively banning same-sex marriage in Côte d’Ivoire.

The Penal Code of Cote d'Ivoire of 2019 removed explicit mentions of same-sex activity in Article 360, but there are still excerpts of the code that could be used to censor LGBTIQ+ topics in practice. There is limited information on the enforcement of these statutes, but there have been reports of government inaction and refusal to allow LGBT organisations to register as charities.

Both the repealed Civil Status Law (1964) and its replacement, the Law Relating to Civil Status (Law No. 2018-862) (2018) indicate in Chapter 7 that the President of the Abidjan Court of First Instance has the authority to order the "rectification of civil status records" when petitioned by an applicant or by a public prosecutor. The legislation does not specify what data may be changed and under what circumstances, so it is unclear whether trans and gender-diverse persons would be permitted to make amendments thereunder. Any amendments made must be noted in the records of the Civil Registry.

In Ivory Coast, medical transitions between the sexes are limited.

No legal recognition.

There are some limited legal protections based on sexual orientation.

-Decree No. 2022-164, approving the National Air Transport Facilitation Program, protects passengers' sexual orientation.
-Article 13 on "Equal Treatment" of the Code of Ethics and Professional Conduct for Customs Officials (2014) establishes that customs officials shall perform their duties impartially and avoid making decisions based on bias related to sexual orientation.
-Order No. 449/MSLS/CAB (2015), issued by the Ministry of Health and AIDS, establishing the creation, powers, organization, and operation of the National AIDS Control Program, establishes in Section 10.7 that one of the functions of those responsible is to contribute to access to services regardless of sexual orientation.

Some ministerial documents include protections for sexual orientation, such as:
- Environmental and Social Management Framework (2020) from the Ministry of Hydraulics and Sanitation. Employment protections.
- Restart Action Plan (2023) from the Ministry of Road Equipment and Maintenance. Protection of vulnerable groups.
- Resettlement Framework (2023) from the Ministry of Health. Protection of vulnerable groups.
- Complaints Management Mechanism (2024) from the Ministry of National Cohesion, Solidarity, and the Fight against Poverty. Protections against sexual harassment.

There are no protections from discrimination in employment for LGBT people and incidents are reportedly quite widespread.

There are no protections from discrimination in housing for LGBT people and incidents are reportedly quite widespread.

There is no ban on surgeries performed on intersex infants in Côte d'Ivoire.

Permanent deferral for homosexual and bisexual people.

Conversion therapy is not banned.

The age of consent for heterosexual sex is 15, while for homosexual sex it is 18.
