The Guinea Penal Code has stated since 1988 that homosexuality is illegal, with punishment being 6 months to three years in prison and a fine of 500,000 (raised from 100,000 in 2016) to 1,000,000 Guinean francs. If the act was committed with a minor (under 21 years), the individual will face the maximum penalty.

Section 9.9.30(b) of the Guinea Aeronautical Regulations (2022) states that the competent State authorities shall not use Passenger Name Record Data data that reveals a person's sexual life or sexual orientation.

Law L/2024/001/CNT/SGG on HIV prevention, care, and protection of people living with HIV in the Republic of Guinea defines "Members of sexual minorities" as "individuals whose sexual orientation or identity falls outside the framework of heterosexuality, such as gays, lesbians, bisexuals, intersex, and transgender people, whether they identify as such or not."

The Labor Code (2014) does not protect LGBT people from discrimination.

In Guinea, neither sexual orientation nor gender identity is a protected class from housing discrimination.

Same sex couple can't adopt, and single LGBT+ applicant can't adopt too in Guinea.

There is no ban on surgeries performed on intersex infants in Guinea.

Homosexuality is currently illegal.

There is no ban on MSM blood donations. While homosexuality is illegal in Guinea, does not automatically mean that MSM blood donations are not accepted. However, MSMs would still face discrimination.
