DescriptionSame-sex marriage is constitutionally banned in Slovakia under Article 41 of the Constitution (amended in 2014), which defines marriage exclusively as a unique union between a man and a woman. Although rulings by the Court of Justice of the European Union (CJEU) oblige EU member states to recognize same-sex marriages legally performed in another EU state for freedom of movement and residency purposes, Slovak authorities explicitly refuse to recognize or register foreign same-sex marriages (such as those legally concluded in Austria) into the national special registry. The Slovak Ministry of Interior and government maintain that foreign same-sex marriages violate the constitutional definition of marriage and the 2025 constitutional amendment, resulting in a total ban on domestic and foreign same-sex marriage recognition.
