DescriptionItaly does not provide explicit hate crime protections based on sexual orientation and/or gender identity.

However, there are some legislative tools available to judges to punish some cases of homophobia or transphobia; like the article 61 of the Criminal Code on crimes commited for "vile and futile" motives that increases of up to a third of the penalty.
In some cases, the aggravating circumstance of the Article 604 of the Criminal Code may be applicated if the reference to the Article Is fully applicable and if the attacker's motive is ispired by feelings of hatred and the manner of the attack reveals an idealogical connotation.

edited by Raven_cake. The regional law of Puglia protects victims against discrimination but there isn't anything about hate crime protections. I added some informations how judges may applicate some aggravations, but i'm not sure about the status, please change it if this is wrong.
