DescriptionDespite recent policy mentions, Myanmar does not have comprehensive legal protections against discrimination based on sexual orientation or gender identity. While some sector-specific policies (like broadcasting or health guidelines) include inclusive language, these are not legally binding protections and do not override existing criminal laws. Same-sex activity between men remains criminalized under Section 377, and transgender people can be arrested under the Police Act. These laws are actively enforced, and LGBT individuals face widespread harassment and violence. There is no national anti-discrimination law offering reliable protection for LGBT people in Myanmar. Since the Coup d'état, state sponsored discrimination has skyrocketed.
