Article 311 of the Penal Code (2015), reads: "Any act based on the sexual identity of women which has the purpose or effect of impeding the recognition, enjoyment or exercise by women, regardless of their marital status, of human rights and fundamental freedoms in the political, economic, social, cultural and civil fields or in any other field constitutes discrimination against women."

Article 5 of the Press and Communications Code (Law 2020-001) defines defamation as a "false accusation that damages a person's honor and reputation. Defamation can be racist, sexist, or homophobic." The law prohibits the dissemination of defamatory comments and defamatory advertising messages.

Articles 17, 27 and 39 of Decree No. 2023-116/PR "Relating to the Collection, Transfer, Processing, and use of Passenger Data" expressly protect "sexual orientation".
