DescriptionArticle 27(27) of the Penal Code, amended by Legislative Decree No. 23-2013, establishes that the following are aggravating circumstances: "Committing the crime with hatred or contempt based on sex, gender, religion, national origin, membership in indigenous or Afro-descendant communities, sexual orientation, or gender identity, age, marital status or disability, ideology or political opinion of the victim."

The same protection remains in effect under Article 31(8) of the new Penal Code (Legislative Decree 130-2017), in force since June 25, 2020.
