Current Version

RegionPoland
IssueRight to change legal gender
StatusLegal, but requires medical diagnosis
Start DateMar 4, 2025
End Date(none)
DescriptionIn connection with the Supreme Court resolution III CZP 6/24, gender change takes place at the request of the person affected by the change, it is no longer necessary to sue the parents, but a divorce is still required. The rest of the procedure is the same and still depends largely on the judge.

Reports (1)
  • Note field is incorrect "The statement that the full copy of a Polish birth certificate still shows a person's old data after a gender marker change is incorrect. This misconception contradicts the principles of rectification under the Polish Act of November 28, 2014 (Law on Civil Status Records). Following a final court order establishing gender (a procedure recently clarified by the Resolution of the Full Civil Chamber of the Supreme Court of March 4, 2025, Ref. No. III CZP 6/24, which applies Art. 36 of the Civil Status Records Act by analogy), the original birth record is legally rectified. When the Civil Status Office issues the full copy, which is a literal repetition of the record (Art. 44 sec. 2), the main text will display the current, correct data because the act itself has been corrected. https://przegladprawamedycznego.pl/pdf-209820-128010?filename=Postepowanie%20w%20sprawie.pdf"
