| Description | In 2022, new legislation only allows intersex persons identified as male or female at birth to request a change to “I.” However, no such recognition is provided to transgender people in Kenya. Despite this, a 2025 court ruling has demanded that the government recognise transgender people as their identified gender. In a landmark ruling in May 2026, the Kenya High Court ruled that the government cannot automatically reject applications to change legal gender and must consider them on a case-by-case basis. |
