DescriptionIn 2020, the Fourth Circuit Court ruled that the Gloucester County School Board violated a trans boy's rights by denying him access to the male restroom. That same year, the Virginia Values Act passed, protecting against discrimination based on sexual orientation and gender identity, including in public accommodations.

Despite this, some school districts have adopted bathroom bans. In addition, Republican former governor Glenn Youngkin established guidelines recommending the adoption of bathroom bans in schools; under a 2020 law, Virginian schools must "adopt policies that are consistent with but may be more comprehensive than the model policies developed by the Department of Education" when it relates to transgender students.

In 2025, the Trump administration moved to cut funding to 5 Virginian school districts that allowed transgender students in bathrooms of their choice. The school districts responded by filing a lawsuit against the Trump administration.
