DescriptionCurrently, neither sexual orientation nor gender identity is recognized as a protected class from hate crimes in South Africa.

In May 2024, the Prevention and Combating of Hate Crimes and Hate Speech Act (which includes protections from hate crimes based on sexual orientation, gender identity or expression, and sex characteristics, among other grounds) was signed by President Ramaphosa and gazetted shortly thereafter. However, the Act has not yet come into force.
